Modification Of Support Orders

Child Support

A party may ask the court to increase or decrease child support. Typically, this happens when there has been a change in the economic status of a party. Common changes in circumstances include the loss of a job, a pay raise, the award or termination of other benefits, or a change in the parenting time. Both parties must submit a current Income and Expense Declaration.

Spousal Support

A party may ask the court to increase, decrease or terminate spousal support. It is the burden of the party asking for the change to prove that there has been a change in circumstances that warrants such a modification. Has a party lost his job or retired, or is she making more money? These are the types of events that could support a change in circumstances. Passage of time alone is not sufficient to show a change in circumstances.
