Paternity claims (known as parentage actions in California) allow unmarried individuals to have a court determine who a child’s parents are. Whereas married individuals are presumed to be the parents of any children born during a marriage, unmarried couples must receive judicial determination in order to be recognized as a child’s parents.

For unmarried parents, child custody, visitation and child support orders cannot be made until their parentage is established. Individuals can establish parentage by voluntarily signing a form called a Declaration of Paternity. When there is some dispute about who a child’s parents are, parentage may be established by order of a court, which can require genetic testing to determine whether a man is the father to any children involved.
