HAL BARTHOLOMEW: Collaborative practice is a new concept where a team of professionals come together to help clients go through their divorce. The team commits that they will not be involved with the clients in the future and in fact, in negotiations fail, the attorneys cannot represent them. It's a real commitment to a good faith negotiation process without resorting to the court system.
One of the major benefits of the collaborative process is the parties working together to resolve things. There's no useless discovery, there's no court appearances, there's no wasted time. The parties meet with the attorneys and the other professionals as needed and they're working face to face.
Many clients are hesitant about the collaborative approach because it's something new and different. What I find is once I've explained to them what it really means and how it can help them, they are choosing it. They make the decisions. And the team is formed to help them, but not to tell them what to do.
The ultimate goal is to help the parties reach a decision that they fully understand. They need to look at how it affects themselves currently and in the future.
